Occupational Health Issue, a Cause of Serious Concern


Construction sites pose serious threat to safety of workers and it is imperative that construction companies have protective measures in place. Millions of workers all over the world are involved in the construction industry and are exposed to building materials that can be serious health hazards.

Construction worker safety is of utmost priority. It has been found that asbestos is one such building material that can cause a number of diseases that can be fatal even. The HSE estimates that over 4,000 workers lose their lives annually due to exposure to asbestos. It is of prime concern then to put measures in place for proper removal and disposal of asbestos.

Norwegian Homes Limited, a Cornwall development company came under scrutiny for breach of Regulation 15 of the Control of Asbestos at Work Regulations 2002. On inspection, HSE inspectors unearthed a large amount of asbestos fibres at a demolition site in Cellar Cover Hotel at Droskyn Point, in Perranporth in July 2006. It was being converted to build holiday apartments and guesthouses.

Inspectors found asbestos fibres in ashes of a bonfire and insulation boards under a caravan. They also unearthed polythene bags of asbestos fibres. It was clearly negligence on the part of Norwegian Homes as they had failed to conduct a proper and thorough survey of the site prior to demolition. It was the responsibility of the construction company to remove and dispose the asbestos in a suitable manner.

The company pleaded guilty on 26 May 2010 and was orderd to pay a fine of £4,500 by Truro Magistrates Court for failing to undertake a proper survey for the presence of asbestos at the demolition site. It also ordered £11,959 in additional costs.

HSE Inspector Martin Lee stressed upon the importance of health hazards at construction sites and asbestos related diseases in particular.

RCN Asks Health Board to Bring Nurses’ Concerns to Public View


Of late, there have been many incidents of whistle blowing in the NHS system. The Royal College of Nursing (RCN) reported that there have been many cases of whistleblowing by nurses every week in the past year and the institute believes that it is high time that the patient-safety concerns raised by the nurses are brought before the public.

The RCN has gathered information via its hotline called ‘Raising Concerns, Raising Standards‘ where nurses often call to register their fears about failure to provide sufficient care to the patients at their hospitals. The hotline was set up at Congress 2009 when a survey of nurses showed that close to 80% are scared of victimisation by their employers if they complained against them.

Two-thirds of nurses had spoken to their employers about patient safety issues and in more than one-third cases, there was not action taken. The hotline is supposed to be the last resort if the nurses have tried all internal measures but have failed to get their grievances addressed.

Some the major concerns include lack of sufficient time to give proper care to each patient and ensure safety. The nurses also believe that the hospitals do not have sufficient nursing staff and therefore, the quality of service is being affected. Some said that employers took decisions that had more to do with financial issues than patient safety.

Tina Donnelly, the Director of the RCN, Wales also confirmed the fact that regular calls were being made to the hotline. Most of the concerns were being raised by nurses. She said it would be best if the health boards maintain a register of these complaints and make them available to the public. This may go a long way in ensuring patient safety and good service.

Company Pays Fine for Failure to Make Loading System Safe


Ross Beddow, an employee of A Hingley Transport Ltd, died on January 4th, 2007 in a mishap that occurred when he was helping to load steel plates on to a lorry. An employee of Corus, the multinational steel company, was operating a crane to lift a pack of steel packs weighing three tonnes at the company’s site in Wombourne. However, the load was not properly placed and due to imbalance, it fell on Ross leading to his death on the spot.

According to the investigation carried on by the HSE, the system of loading steel was unsafe for the workers. The company had not done the risk assessment of the different roles to be performed by individuals and therefore, there was a possibility of confusion among them. This may have caused the accident. As a result, the company was prosecuted by the HSE for violating Section 3(1) of the Health and Safety at Work etc. Act 1974. The company pleaded guilty for the same. As a result, Stafford Crown Court ordered the company to pay a fine of £240,000 and £112,500 towards costs.

According to HSE Inspector, Dr Wai-Kin Liu, this accident could have been easily avoided if the company had spent some time trying to create a proper system of loading steel. All that was needed was the assessment of the system to eliminate any possibility of confusion.

While it is true that errors can be made by anyone, the company failed to even develop a system to ensure the protection of the workers. This could have saved the victim’s life.

However, according to Charles Feeny, the advocate for Corus, the company has made a mistake and is sorry for it. It had assessed and used the system for years and actually believed that the system was safe. It will, he stated, do its best to change the system.
